Anything we should know before we attend, or any variation to this agreement that has been agreed with us in writing — for example access arrangements, a second pool or spa, a preferred time window, or a dog on site. Whatever you write here is recorded on your agreement.

This section summarises the statutory obligations of the registered certifier who will assess your swimming pool or spa pool barrier, your obligations as the pool owner, and the information found on Fair Trading’s online register of registrations and approvals.

By agreeing to this, you indicate you have freely chosen to engage the registered certifier, read the contract and any accompanying documents, and understand your role and responsibility as the owner and that of the registered certifier.

Agents acknowledge they have written authority.

As Owners / Applicant / Authorised Agents for the owners of the land to which this application relates, I/We consent to this application.* I/We also consent for an Authorised Inspector to enter the land to carry out inspections including taking photos and/or videos related to this application.* I/We must ensure safe and unobstructed access to all pool and barrier areas at the scheduled time. Pets must be secured and any hazards disclosed prior to inspection.* I/We grant permission to access the property to conduct a reinspection if required for the purpose of issuing a Certificate of Compliance. A Certificate of Compliance cannot be issued unless the barrier is physically inspected. Photo or video documentary evidence cannot be provided by the pool owner in lieu of a physical reinspection of the barrier.* I/We accept that all communication regarding this application will be through the nominated applicant(s). This includes the declaration by the applicant that he/she: a) has freely chosen to engage the certifier, and b) has read the contract and any accompanying document and understands his/her responsibilities and those of the Inspector.* I/We have read and agree to the Terms & Conditions.* I/We acknowledge that Pool Owners who want to comply should be aware of the changes in legislation with the introduction of the Swimming Pools Regulations 2018 and as such their pool enclosure may be required to be upgraded to AS1926.1-2012 requirements.* I/We acknowledge that the NSW Department of Fair Trading has advised Pool Inspectors that all pools must now be assessed under the current Australian Standard AS 1926.1 – 2012 unless the inspecting Certifier has documentary evidence of a pool and barrier existing in place on 31 August 2008 and documents showing compliance with AS 1926 – 1986 and Part 2 of Swimming Pool Regulation 1998.* I/We acknowledge that if at an inspection, a barrier is found to be non-compliant with AS 1926 – 1986 or Part 2 of SP Regulation 1998, a Certificate of Compliance cannot be issued. This applies even if fixing the barrier's non-compliance doesn't involve the barrier being substantially altered or rebuilt.*
